By downloading, installing, or using the Offcue iOS App (“App”), you agree to these Terms of Use – also referred to as "Terms". If you do not agree, do not access or use the App.
Subject to your compliance with these Terms, Offcue grants you a limited, non-exclusive, non-transferable, revocable license to use the App on any iOS device you own or control solely for your personal, non-commercial use.
Some features require payment of fees or subscriptions through the App Store and validated via RevenueCat. All billing and refunds are subject to Apple’s policies. Offcue does not process payments directly.
The App is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, whether express, implied, statutory, or otherwise. Offcue expressly disclaims all warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free or uninterrupted.
To the maximum extent permitted by law, in no event shall Offcue or its affiliates, officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the App, even if advised of the possibility of such damages. Our total liability to you for any claim under these Terms shall not exceed the amount paid by you, if any, for the App.
You agree to defend, indemnify, and hold harmless Offcue and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your breach of these Terms or your use of the App.
These Terms remain in effect until terminated by either party. You may terminate at any time by uninstalling the App and ceasing use. Offcue may terminate or suspend your access immediately, without notice or liability, for any breach of these Terms.
These Terms are governed by the laws of the State of Utah, USA, without regard to conflict of laws principles. Any dispute arising out of or relating to these Terms shall be resolved exclusively in the state or federal courts located in Salt Lake City, Utah.
We may modify these Terms at any time. We will update the “Last updated” date and notify you in-app where feasible. Continued use of the App after changes constitutes acceptance of the new Terms.
